Conservative, product-specific terms for using PulseGate as an informational market index.
PulseGate is an informational market index. It does not provide reviews, endorsements, investment advice, legal advice, or guarantees of ranking, inclusion, or completeness.
1. Who Operates the Service
PulseGate is operated by Dimaxia s.r.o., with its registered office at [full registered address, Prague, Czech Republic] (“PulseGate”, “we”, “our”, or “us”).

2. Description of the Service
PulseGate is an informational market index for public software products, models, infrastructure, and workflow tools. The Service aggregates and presents public-facing signals drawn from multiple source families in order to help users understand software market movement, ranking, intake, freshness, and related public visibility patterns.
The Service is designed to improve orientation in software ecosystems. It is not a software review site, not a marketplace, and not a certification program.
3. Informational Use Only
The Service is provided for general informational purposes only. Rankings, scores, category placements, freshness indicators, and similar outputs are directional signals derived from public-source evidence and related system rules.
The Service does not provide legal advice, financial advice, investment advice, procurement advice, or professional advice of any kind.
You remain responsible for your own decisions, evaluations, and due diligence.
4. Rankings, Listings, and No Entitlement
No person, company, project, or product has any right to:
PulseGate may add, remove, reclassify, suppress, or update entries, scores, and supporting signals at any time, including in response to source changes, quality checks, duplicate handling, abuse controls, methodological changes, correction requests, or internal operational decisions.
Listing in the Service does not imply endorsement, recommendation, certification, partnership, affiliation, or approval by PulseGate.

- receive any particular score, rank, category assignment, or descriptive label;
- receive any minimum level of visibility, coverage, freshness, or update frequency; or
- require that any specific source, signal, or public surface be included in the Service.
5. Accuracy, Availability, and Public-Source Dependence
We aim to make the Service useful and readable, but we do not guarantee that any content, ranking, score, timestamp, category assignment, trend signal, or related information is complete, accurate, current, reliable, or suitable for any particular purpose.
The Service depends in part on public-source availability, third-party surfaces, and source-family corroboration. Public information may be incomplete, stale, delayed, inconsistent, withdrawn, or technically difficult to observe.
Some categories, regions, products, or source families may have lower coverage than others.
6. Corrections and Reporting Issues
If you believe a listing, score, category assignment, description, link, or related signal is inaccurate or misleading, you may submit a correction or issue report using the Report an Issue route or the Contact page.
We may review reported issues, but we are not obligated to make any requested change, provide any specific outcome, or respond within any specific timeframe unless required by law.
7. Eligibility and Acceptable Use
You may use the Service only in compliance with applicable law and these Terms.
You must not:
- use the Service in a way that violates any applicable law, regulation, or third-party right;
- interfere with, disrupt, damage, disable, overburden, or impair the Service or its infrastructure;
- attempt to gain unauthorized access to any part of the Service, related systems, or accounts;
- use the Service to transmit malware, malicious code, spam, or abusive traffic;
- impersonate any person or entity or misrepresent your affiliation with any person or entity;
- circumvent access controls, rate limits, or technical protections;
- reproduce, scrape, harvest, or systematically extract substantial portions of the Service itself except as expressly permitted by us or by applicable law.
8. Third-Party Content, Links, and Trademarks
The Service may display or link to third-party websites, product pages, stores, repositories, status pages, and other public surfaces. We do not control those third-party resources and are not responsible for their content, availability, policies, or practices.
Any trademarks, logos, and brand names appearing in or referenced by the Service belong to their respective owners. Their appearance does not imply endorsement, affiliation, sponsorship, or approval unless explicitly stated by us.
9. Intellectual Property
The Service, including its original content, software, design, text, layout, and branding, is owned by PulseGate or its licensors and is protected by applicable intellectual property laws.
These Terms do not grant you any ownership rights in the Service. Except as permitted by law or by these Terms, you may not copy, modify, distribute, republish, or create derivative works from the Service.
10. Suspension, Modification, and Termination
We may modify, suspend, restrict, or discontinue any part of the Service at any time, with or without notice, including specific pages, source integrations, scoring logic, data visibility, or programmatic access.
We may suspend or terminate your access if we reasonably believe you have violated these Terms, created security or operational risk, or used the Service abusively or unlawfully.
11. Disclaimers of Warranties
To the maximum extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Service will be uninterrupted, secure, error-free, or continuously available.
12. Limitation of Liability
To the maximum extent permitted by applicable law, PulseGate and its officers, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, business opportunity, data, or use, arising out of or related to your use of or inability to use the Service.
To the extent permitted by law, our aggregate liability arising out of or relating to the Service will not exceed [insert amount or conservative placeholder], or, if higher and required by applicable law, the minimum amount permitted under that law.
13. Consumer Rights Savings Clause
Nothing in these Terms excludes or limits any rights or remedies that cannot be excluded or limited under applicable consumer protection or other mandatory law.
If you are a consumer, mandatory protections under the law of your habitual residence may apply in addition to these Terms.
14. Governing Law and Disputes
These Terms are governed by the laws of the Czech Republic, excluding conflict-of-law rules, except where mandatory law requires otherwise.
Any dispute arising out of or relating to these Terms or the Service will be submitted to the competent courts of Prague, Czech Republic, unless applicable law gives you the right to bring a claim elsewhere.
15. Changes to These Terms
We may update these Terms from time to time. If we do, we will post the updated version on this page and update the “Last updated” date above.
Your continued use of the Service after the updated Terms become effective means you accept the revised Terms, to the extent permitted by law.
